Each place, whether located in the state of North Carolina or outside the State of North Carolina, that dispenses devices or medical equipment to patients in the State must obtain a device and medical equipment permit.

The DME permit requirement does not apply to a pharmaceutical manufacturer registered with the Food and Drug Administration; a wholly owned subsidiary of a pharmaceutical manufacturer registered with the Food and Drug Administration; and to the delivery of certain renal products. Further, a health care professional licensed under Chapter 90 of the North Carolina General Statutes who is providing medical equipment directly to his/her own patients as a part of treatment does not have to obtain a DME permit.
