No Owner Shall Operate A Device Unless There Is In Existence A Contract Of Insurance Providing Coverage (Against Liability For Injury To Persons Or Property Arising Out Of Operation Or Use Of The Amusement Device). Insurance Contract To Be Provided Must Be By An Insurer Or Surety That Is Acceptable To The NC Insurance Commissioner And Authorized To Transact Business In This State. Amount Of Coverage Required Depends On The Type Of Device Insured And Annual Gross Volume Of The Device. Fees run from $35 (Go Karts) up to $250 (Permanent roller coasters); $250 per Amusement device re-inspection fee (if ride fails inspection); $250 per ALN for after-hours/weekend/holiday inspections.
Unless They Are Located In An Amusement Park Or Carnival Area, The Following Devices Or Attractions Are Exempt From The Amusement Device Safety Act: Hot Or Cold Air Inflatable Devices (Balloons Only, As Interpreted By DOL/Clyde Wagner or Bumper Boats; And Simulator Devices That Simulate The Movement Shown On Various Video Tapes.
