Issued To Businesses/Services Engaging In The Business Of Providing Information And/Or Services, For A Fee, To Promote, Lead To, Or Result In Employment With Any Employer Other Than The Service Itself. Such Services Are Required To Be Licensed Only If The Applicant Is Responsible For Paying The Fee. If The Employer Is Responsible For The Fee, The Statute Requires That The Service File A Certification Indicating Such With The Department Of Labor.

Each Applicant, Owner, Officer, Director And/Or Manager Must Pass A Background Investigation Into His/Her Character, Criminal Record, And Business Integrity; Must Deposit $10,000 Bond Executed By Duly Authorized Surety Company; Must Submit A Detailed Schedule Of All Fees And Charges That Will Be Made For Services Rendered To Clients; Must Submit For Approval A Copy Of Any Contract Clients Will Be Required To Sign.
Any Educational, Religious, Charitable, Fraternal Or Benevolent Organization Not Charging A Fee.; Any Employment Service Operated By The Government Or Its Agencies.; Temporary Help Service That Does Not Advertise Or Represent That Its Employee May, With The Services Approval, Be Employed Permanently By Its Client Companies. Newspapers Of General Circulation That Doesn't Profess To Adapt Information To The Needs Or Desires Of An Individual Subscriber. Services That Charge No Fee To The Applicant Or Employer And Under A Valid Union Contract By The Employer Subscribing To This Contract. Any employer fee paid personnel consulting service or temporary help service that offers temporary to permanent placement when the service operates on a one hundred percent (100%) employer fee paid service basis, requires no applicant placement contract, and has no recourse against an applicant for a fee under any circumstances.
