Permits To Operate Waste Management Facilities Are Issued Only After Site And Construction Plans Have Been Approved And It Has Been Determined That The Facility Can Be Operated In Accordance With The Solid Waste Management Rules Affecting Demolition Landfills.

Landfill Under 2 Acres Does Not Require A Permit; However, A Notification Form Must Be Submitted And Approved. Permit Applications Should Contain The Following Information: Site And Construction Plans; An Approval Letter From The Unit Of Authority Over The Area Where The Facility Is To Be Located; Any Other Information Pertinent To The Proposed Facility.
A Landfill With A Disposal Area Of One Acre Or Less For The Disposal Of Demolition Debris Generated On The Same Property On Which The Landfill Is Located Is Governed By 1301-301.2. If The Conditions Found In The Statute Are Met There Is No Permit Requirement From The Section.
