Any person who acts as a professional fundraising consultant or professional solicitor shall apply for and obtain a license from the Secretary of State.

A salaried employee of the person for whom the contributions are solicited or of its Tax Exempt Parent Organization is not included within the term. An Attorney, Investment Counselor Or Banker, who advises any person to make a contribution to a person established for a charitable purpose is not as the result of such advice, A Professional Fund Raising Counsel or Professional Solicitor.
